not illegal and just on the books.

Who says they are not illegal and just on the books. It's still a crime and not just a marital matter but a criminal matter as well. They are legally illegal. Though the prosecutions are rare but they do happen. Orange County Bail Bonds It's not a family matter but a legal matter.
